Dear Customer,
We would like to inform you that the general terms and conditions of sale set out below indicate, in compliance with current consumer protection laws, the conditions and methods by which you can proceed with the online purchase on the Salotticalabria.it website owned by Calabria Domenico, from now on referred to as the Seller, of products of your interest in a safe, easy and convenient manner. We therefore invite you to read and accept them in order to proceed with the purchase.

These General Terms and Conditions of Sale govern the sale of products marketed by the Seller to consumer users and users acting for business purposes.
These general terms and conditions shall be effective from the date of their acceptance by the customer on the site, which shall to all intents and purposes constitute acceptance pursuant to Article 1341 of the Civil Code.
The Vendor reserves the right to amend these general sales conditions at any time by posting them on the site.
Any contractual or extra-contractual liability of the Seller for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order is excluded.

1 - Acceptance
Mail-order, retail and wholesale purchases with contract Law Art.62 D.L. n.1/2012 are understood to be passed and concluded under these conditions.

MODE OF PURCHASE

Products are purchased by accessing the site and registering. For each of the products, a description containing their main characteristics is available on the site. All information supporting the purchase is intended merely as general information material.

It is understood that the picture accompanying the product description may not be perfectly representative of its characteristics, but may differ in colour, size, and accessories in the picture.
Correct receipt of the order is confirmed by the Seller by means of an automatic reply by e-mail, sent to the e-mail address communicated by the customer at the time of registration. This confirmation message will contain an "order number" to be used in the event of any communication with the Seller. The message will contain all the data entered by the customer, who undertakes to check that they are correct and to promptly communicate any corrections.

In the event of non-acceptance of the order, the Seller shall notify the customer without delay.

2 - Contracts
They shall be deemed to have been concluded unless sold and subject to price changes at the time of delivery or dispatch.

3 - Shipping risks
The seller shall not be liable for misunderstandings caused by insufficient address provided by the Customer. The goods travel at the risk and peril of the Customer and no claims for delays, breakdowns and losses resulting from transport shall be accepted, even if the goods are free of port; such claims must be made to the courier before collecting the goods. For each order placed, the seller shall issue a sales document for the material shipped.

No liability can be attributed to the seller in the event of delay in the processing of the order or in the delivery of what has been ordered. Upon delivery, the customer is obliged to check that the packaging is intact, neither damaged, nor wet, or otherwise altered.

Any damage to the product or packaging or the mismatch of indications must be immediately contested to the courier by affixing WRITTEN CONTROL RESERVE on the courier's proof of delivery. Once the courier's document has been signed, the customer may not raise any objection regarding the external characteristics of what has been delivered.

The goods are delivered by a contracted express courier service.
If the mode of delivery is not satisfactory, please do not evaluate our service negatively, as the courier is not an employee of our company. The product will be replaced as soon as possible.

Delivery costs are borne by the customer and are indicated when placing the order.

4 - Payments
All prices on the site are public prices and, therefore, include VAT.
Prices may vary without prior notice and the only correct price is the one indicated at the time of order confirmation.

Goods are sent only after acceptance of the order and receipt of credit.

The seller reserves the right to request additional documents from the customer proving ownership of the credit card. If the seller fails to send the documents, the seller reserves the right not to accept the order. Transaction security is guaranteed by a data encryption system (SSL) and direct, protected and certified connections.
Payments can be made in different ways: Credit Card or PayPal and Bank Transfer.

We accept the most popular credit cards.

PayPal
PayPal is an online payment system that requires you to open an account with PayPal. By choosing this method, after clicking "send order", you are redirected to a page on the PayPal site where you enter your PayPal account e-mail and password in order to pay for your order. For each transaction performed by this method, a confirmation e-mail is sent by PayPal. The amount of the order is debited from your PayPal account when the order is placed. In case of cancellation, the amount is refunded to the customer's PayPal account.

Bank transfer
In the case of payment by bank transfer in advance, the order will only be processed once we have received confirmation of the bank transfer. The reason for the bank transfer must necessarily state the order number and the customer's first and last name.

5 - Complaints
The goods must be checked upon receipt. COMPLAINTS ARE ONLY ACCEPTED IF MADE BY E-MAIL, FAX OR POST. COMPLAINTS BY TELEPHONE ARE NOT ACCEPTED. Please enclose a photo with your complaint. No complaints will be accepted after three days of receipt of goods (packaging, faults, discrepancies).

6 - Right of withdrawal
The Customer's rights are protected by Legislative Decree 206/2005 as amended. The Customer has, therefore, the right to withdraw from the contract, even partially, without explanation and without incurring any expenses, provided that the withdrawal is communicated by registered letter A/R to Salotti Calabria di Calabria Domenico - Corso Savona, 36 - 10024 Moncalieri (To) - Italy, within 14 working days from the day of receipt of the products. The communication can be anticipated, within the same term, by e-mail (to the address info@salotticalabria.it) or telegram, provided that it is confirmed by registered letter A/R within the following 48 hours. Such communication shall specify the intention to withdraw from the purchase and the product or products for which the right of withdrawal is to be exercised, attaching a copy of the transport document. The customer must then return the product at his own expense to Salotti Calabria di Calabria Domenico - Corso Savona, 36 - 10024 Moncalieri (To) - Italy.

The consumer must then provide, using a courier of his choice, for the shipment of the product (in its original packaging and, in any case, always carefully packed) and complete with every accessory and everything originally contained therein. The consumer must make such shipment within ten working days from the date on which he/she sent the communication exercising the right of withdrawal.

This right applies to all products purchased online on this site, with the exclusion of products delivered sealed and subsequently opened by the customer. The cost of returning the product shall be borne by the consumer.

he right of withdrawal is totally forfeited if the returned product is not intact, due to the absence, for example, of integral elements of the product (accessories, manuals, etc.) or if the product has been damaged for reasons other than transport from the Seller to the consumer, not previously reported.
Without limiting the right of withdrawal, upon delivery of the product the consumer, who has reason to believe that the product itself has been damaged during transport, shall refuse the delivery or accept it with express reservation.

Important notes
Transport costs and responsibility for the goods during shipment, as required by law, are the responsibility of the consumer.
It is therefore advisable to insure the product with the chosen courier, taking care to pack the goods carefully, where possible placing the original packaging in an outer box and, in any case, avoiding damaging the product with adhesive tape, labels, etc. The product must be returned intact and complete with all its parts and accessories. In the event of transport damage occurring during the return, the Seller shall notify the consumer of the damage within five working days of receipt of the product, allowing the consumer to file a complaint with the carrier used for transport. The damaged goods will be made available for return and the request for withdrawal will be cancelled at the same time.

With the exception of what is set forth below for the case of partial withdrawal, the Vendor shall refund, within 30 days from the time the Vendor has become aware of the exercise of the right of withdrawal, the full amount of the purchase and the transport costs for delivery, by means of a transfer to the credit card or by bank transfer to the current account indicated by the consumer; the transport costs for the return of the product shall remain the responsibility of the latter.

In the event that the withdrawal is partial (i.e. concerns only a part of the products delivered in a single delivery), reimbursement of the shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded.
With regard to purchases with collection at a Seller's point of sale, the right of withdrawal is not applicable since this is not a distance sale. In fact, in that case, the consumer has only reserved the product via the Internet, but has not yet purchased it and will have to go to the point of sale to do so.

Order Cancellation Request
The purchase order may be cancelled in full if, at the time of the cancellation request, shipment of the product is still being prepared and, in any case, if the amount has not yet been collected, in which case no costs will be charged to the customer.

If at the time of the request for cancellation of the purchase order the product is already entrusted to the carrier or, in any event, the amount has been collected, the consumer shall exercise the right of withdrawal and return the goods to the Seller.

For purchases made with one of the following payment methods:

Bank transfer:
Calabria Domenico will proceed with the reimbursement by bank transfer.

For purchases made by Credit Card/PayPal payment, the refund will be made to the customer's PayPal account.
The Customer shall be liable for any diminution in value of the returned goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Notwithstanding the above, the right of withdrawal is not permitted in the case of:

  • purchase of sealed packaged products opened by the customer;
  • of goods that by their nature cannot be returned or are liable to deteriorate or alter rapidly;
  • Tailor-made products, i.e. indications dictated by the customer at the purchase stage (e.g. fabric cutting, customisation, made-to-measure products, etc.).

7 - Product guarantees
Established in 1981 Salotti Calabria di Calabria Domenico has constantly improved the quality of its products.
It has high-profile Professionals, Technicians and Craftsmen and relies on their expertise to check the products made before they are put on sale.
If Salotti Calabria recognises the defect, it can choose to replace or repair the defective products or offer an alternative product with the same essential characteristics; if the repair or replacement proves impossible or exceeds the cost of the invoiced value of the defective products, Salotti Calabria can withdraw from the sales contract by refunding the purchase price to the buyer (transport and installation costs excluded); it is always necessary for Salotti Calabria to examine the defective product, dismantling and transport costs are the responsibility of the buyer. Any costs arising from the dismantling of the defective products and the installation and/or replacement (new or repaired) will be borne by the purchaser, including: per diem and travel expenses, lifting devices, scaffolding, or any other incidental expenses;
Salotti Calabria is not responsible for any material or immaterial damage suffered by the Buyer or by third parties resulting from the ascertained defect, such as loss of use, loss of profits and loss of savings; however, in the event of serious damage caused by technical defects in the products due to construction, design or material defects attributable to Salotti Calabria, the latter is willing to participate with a refund of a maximum of 10% of the value of the invoiced goods, as a contribution to documented costs that the Buyer may incur.
This participation will be defined and agreed on a case-by-case basis.

8 - Jurisdiction
The sales contract between the customer and the seller is concluded in Italy and governed by Italian law. For anything not otherwise established, Italian law shall apply. For any disputes that may arise, the parties expressly acknowledge the territorial jurisdiction is exclusively that of the Court of Turin.

PERSONAL DATA
Pursuant to and for the purposes of Legislative Decree No. 196/03 (so-called "Privacy Code"), the parties declare that they have mutually informed each other that the personal data collected for the formalisation of this deed are subject to processing in the Customers/Suppliers file and are necessary for the correct management of civil and tax obligations. Such data may also be processed for management, statistical and commercial purposes. The parties holding the respective data also expressly declare that they are aware of the contents of Article 7 of the aforementioned decree.
